Media release: KCL Law advises Maben on building contract for the Box Hill Central Southern Precinct (West End) Redevelopment

KCL Law’s Construction and Infrastructure team recently advised Maben and assisted negotiations in regard to the building contract for the redevelopment of Box Hill Central Southern Precinct (West End) by one of Australia’s largest retail real estate businesses, Vicinity Centres.

Creating a high-quality and integrated shopping precinct, the 10,500 square metre redevelopment of retail and car park lobby areas includes a new southern entry and mall extension to accommodate a new Coles Supermarket among other retail stores.

Construction commenced in July 2021 and is due to be completed in late 2022. The redevelopment of Box Hill Central’s southern precinct is the first part of a major redevelopment project, turning Vicinity’s entire Box Hill Central asset into a market-leading mixed-use destination boasting commercial offices and residential living as well as the already popular retail centre.

Principal Lawyer Damien Simonetti and Lawyer Jaimi Johanson advised Maben’s Director heading the project, Ben Pedersen and his team, assisting in negotiations on the amended AS4300-1995 Design and Construct Contract which involved a number of complexities including design risk and novation of consultants, delay events, COVID and legislative entitlements, insurances, indemnities and order of document precedence.

The Construction and Infrastructure team’s role in the redevelopment of Box Hill Central follows other successful and complex contract advices and negotiations that KCL Law has been closely involved in with Maben, including:

  • four separate amended AS4902-2000 Design and Construct building contracts in relation to the ongoing redevelopment of Highpoint (including the centre’s aesthetic upgrades Stage 1 and Stage 2Myer and Target) by investment trust GPT Group; and
  • a completely bespoke design and construct building contract for EastCo, the new Victorian Department of Transport Head office currently under construction in Ringwood by the Queensland Investment Corporation (QIC).

The team has also provided ongoing project advice to Maben in relation to the EastCo project on programming and general contract administration.
