Update regarding probate advertisements: Changes to probate advertisements are coming soon.

Prior to a grant of representation in Victoria publication of notice by the applicant of their intention to apply for the grant is required.  From 11 November 2024, the Supreme Court (Chapter III Probate Advertising Amendment) Rules 2024 will introduce two key updates:

  1. Expiry date for notices: Notices will now expire three years from the posting date (previously, no expiry).
  2. New publication platform: Notices will need to be published via RedCrest-Probate, replacing the old POAS system on the Court’s website.

Additionally, the new rules clarify and expand the details required in the notices, though many of these are already best practices for professionals. The KCL Law Estate Administration Team is pleased to see these requirements formalised, which include:

  • Referencing any known aliases of the deceased
  • Including any codicils
  • Disclosing the last known address of the deceased
  • Providing an explanation if any named executor is not applying for the grant
